Frequently Asked Questions

A trademark renewal can be filed at any time within one year before the expiry date (i.e., from 9 years after the application date). If not renewed before expiry, it can still be renewed within six months after the expiry date with a surcharge. After the six-month surcharge window, the mark is removed from the register.

A renewed trademark is valid for a further 10 years from the date of expiry of the previous registration — not from the date of filing the renewal application. This means continuous protection is maintained from the original application date through successive renewals.

Yes. A trademark that has been removed from the register for non-renewal can be restored by filing a TM-R restoration application within one year of the date of removal — with payment of the restoration fee and surcharge. After one year from removal, restoration is not available and a fresh application is required.

No. The Trade Marks Act does not require proof of use at the time of renewal in India. Renewal is an administrative process — filing the TM-R application and paying the fee is all that is required. However, non-use for five consecutive years is a ground for cancellation if raised by a third party.
